General Information about Workers’ Compensation Appeals

Introduction to Appeals:

An overview of the Alaska Workers’ Compensation Appeals Commission (Commission). The Commission started hearing appeals of decisions from the Alaska Workers Compensation Board (Board) in cases decided after November 7, 2005.

It reviews appeals of final decisions and orders of the Board and considers petitions for review of interlocutory or other non-final decisions or orders of the Board. For further information about the Commissioners, Commission regulations, and copies of decisions, click on the provided links.

 

Filing Requirements and Timeline:

Appeals of final decisions and orders of the Board must be filed within 30 days after the Board serves the final decision and order to the parties involved. Appeals are initiated by a party in interest against all other parties in the Board proceedings.

If a petition for reconsideration of a Board’s final decision and order is timely filed, any appeal proceedings must be initiated with the Commission within 30 days after the Board serves the reconsideration decision and order, or within 30 days after the petition for reconsideration is considered denied due to the absence of any Board action, whichever occurs earlier.

 

Petitions for Review of Non-Final Board Decisions:

Petitions for review of non-final Board decisions must be submitted within 15 days after the Board serves the parties with the non-final decision or order. If a petition for reconsideration of a non-final decision or order is timely filed with the Board, any petition for review must be filed with the Commission within 15 days after the Board serves the parties with the reconsideration decision and order, or within 15 days after the date the petition for reconsideration is considered denied due to the absence of any Board action, whichever occurs earlier.

Responding to an Appeal Without an Attorney:

In case the opposing party files an appeal of a Board decision in your favor and you lack legal representation, the Commission provides an instruction packet and forms. Options for obtaining this packet for responding to an appeal or filing a cross-appeal can be found by clicking here. Note that filing a cross-appeal is not mandatory; refer to the instruction packet for details.

Filing Deadline:

Documents are considered “filed” on the date received by the Commission by 5 p.m. Alaska time. If received after 5 p.m., on a Saturday, Sunday, or state holiday, filing will be acknowledged on the next regular workday.

 

Alternative Filing Methods:

Fax: Documents can be filed with the Commission via fax at (907) 269-6737. The first page of appeal documents filed by fax will be stamped “FILED” with the date, and a copy of the stamped page will be faxed back.

Email: Electronic filing is possible by converting documents to a “.pdf” format and emailing them to awcac.clerk@alaska.gov. A confirmation email will be sent for electronically filed appeal documents.
